Please read these Terms of Service (“Terms") carefully before using www.paradigmtogo.com ("Site") or any service offered by Paradigm One Benefit LLC (“Paradigm One,” "we," "us," or “our.”). Unless you accept this agreement, you are not authorized to use the site or any Paradigm One service. By visiting, browsing, or using the site or any Paradigm One service, you agree to this agreement including any additional terms, conditions, and policies incorporated by reference into it.

This Agreement applies to all Site visitors and users of the Site or Paradigm One Services. If you do not agree with any term or condition in this Agreement, please do not use the Site or any Paradigm One Services.

WELCOME TO PARADIGM ONE!

Paradigm One Benefit LLC is a circular economy company that operates a reusable food container program intended to help consumers and foodservice providers reduce the amount of single-use disposable waste in our communities and the environment.
Paradigm One offers its members multiple levels of memberships which can be subscribed to monthly or annually. By subscribing to any of these, you become a Paradigm One Member.

SUBSCRIPTION SERVICES

1. Monthly Subscription: By purchasing a Monthly Subscription, you agree to an initial and recurring Monthly Subscription fee at the then-current Monthly Subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your Monthly Subscription at any time, subject to the terms of our cancellation policy.

Automatic Renewals (Monthly): Once you have subscribed, Paradigm One will continue to automatically process your recurring Monthly Subscription fee each month using the payment method you selected (credit card, debit card, ACH, etc.) and at the then-current Monthly Subscription rate, until you cancel your subscription. We explain how to cancel your Monthly Subscription below at the Section "Cancellation Policy".
Cancellation Policy (Monthly): You may cancel your Monthly Subscription at any time by logging into your account, clicking on subscriptions and following the cancellation process. If you cancel your Monthly Subscription, the cancellation will take effect on your next monthly billing cycle. You will not be eligible for a refund for monthly subscription fees paid prior to the month the cancellation takes effect. You will be charged for any outstanding penalties due at time of cancellation (see Penalties section below).

2. Annual Subscription: By purchasing an Annual Subscription, you agree to an initial pre-payment for one full year of service. After one year and annually thereafter, you will be billed a recurring Annual Subscription renewal fee at the then-current Annual Subscription rate. We will notify you before the renewal fee is billed. You may cancel your Annual Subscription anytime before the next billing cycle, subject to the terms of our cancellation policy.

Automatic Renewal (Annual): Once you have subscribed, Paradigm One will automatically process your recurring Annual Subscription fee in the first month of your next Annual Subscription using the payment method you selected (credit card, debit card, ACH, etc.) and at the then-current Annual Subscription rate, until you cancel your subscription. For example, let's say you purchased an Annual Subscription beginning in March 2021 and ending in February 2022. We will process your second year (March 2022 to February 2023) payment in March 2022, unless you cancel your Annual Subscription before March 2022. You accept responsibility for all recurring charges prior to cancellation. We explain how to cancel your Annual Subscription below at the Section "Cancellation Policy".
Cancellation Policy (Annual): Cancellation Policy for Annual Subscription Renewals: Annual Subscription fees are non-refundable. You may cancel your Annual Subscription renewal at any time after you are billed for the then-current year and before you are billed for the next year, by logging into your account, clicking on subscriptions and following the cancellation process. You will be charged for any outstanding penalties due at time of cancellation (see Penalties section below).

3. Missing or Damaged Container Fee: If you do not return the containers you have checked out within thirty (30) days of the date you checked them out you will be charged a Missing Container Fee of $5.00 per missing container. Paradigm One will send you reminders to return your containers if you have not returned them within fourteen (14) days, twenty-one (21) days, and twenty-eight (28) days. If you return containers that has been damaged beyond the point where it can be commercially reused, you will be charged a Damaged Container Fee of $5.00 per damaged container. You will NOT be double charged both missing and damaged fees for the same container; only one fee or the other, if and as applicable.

PRO TIPS:
- Avoid Missing Container Fees by returning your containers soon after you have used them.
- Avoid Damaged Container Fees by using the containers only for the purpose they are intended, putting them back into the bag they came in right after you have used them, not using sharp utensils or placing heavy objects on them, and keeping them away from extreme and direct heat sources such as open flame, stove-tops, conventional ovens, hot metal, etc.; using the containers in microwaves is fine.

4. Extra Container Fee: If you check out and/or have in your possession at any time more than one (1) additional container beyond what your Membership Level allows, you will be charged an Extra Container Fee of $0.50 for the use of each additional container beyond that one (1) additional container above your Membership Level’s container allowance.

For Example:
- If you have a Membership that allows you to check out up to three (3) containers at a time and you have checked out four (4) containers, you will not be charged for the one (1) additional container beyond your Membership Level’s container allowance.
- If you have a Membership that allows you to check out up to three (3) containers at a time and you have checked out five (5) or more containers, you will be charged a $0.50 Extra Container Fee for each extra container beyond that one (1) additional container beyond your Membership Level’s container allowance.
PRO TIPS:
- Return any used containers to either a Collection Kiosk or Restaurant Return Bin (where available) before making or picking up another order, especially if you know the new order will cause you to go over your Membership Level’s container limit.
- If you find that you are frequently going over your current Membership Level’s container allowance, you can upgrade your subscription to the next Membership Level at any time.

MODIFICATIONS TO TERMS OF SERVICE

We may change the Agreement or these Terms of Service at any time for any reason by updating this posting. You are responsible for periodically reviewing these Terms of Service for revisions. Changes in the Terms of Service will be effective when posted. If we make a material change, we will notify you here in this Terms of Service agreement or by any other means we deem appropriate. Paradigm One may determine, in its sole discretion, in good faith, what constitutes a "material change" using common sense and reasonable judgment. Your use of the Site or any of the Paradigm One Services after we have modified this posting will constitute your acceptance of any changes.
License and Proprietary Rights (a) Copyright and Ownership. The Site, App, and all associated Content, design, text, graphics, and interfaces; as well the collection, selection, and arrangement thereof; and all associated software (collectively, the “Paradigm One Materials”), are the sole and exclusive property of, or duly licensed to, Paradigm One. Consent is granted to view, electronically copy, and print in hard copy portions of the App and Site for the sole purpose of using the Paradigm One Service. Any other use of the Paradigm One Materials, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of Paradigm One is strictly prohibited. You acknowledge that Paradigm One and/or third-party content providers remain the owners of such Paradigm One Materials and that you do not acquire any of those ownership rights by downloading copyrighted material. Paradigm One reserves the right to revoke this authorization at any time, and any use shall be discontinued immediately on written notice from Paradigm One.
